Step 1 – To write the termination of the lease, one would have to find the original lease to find the date it was signed and when the date of payment. The termination of the Alabama lease is not the same as the Alabama Eviction Notice. The procedure for evicting your lease begins when a notice of ownership is issued by the court in an illegal action by the landlord. The Writ of Possession is a court order authorizing the sheriff to physically remove a person and all of their property from the premises and return ownership to the owner. Evacuation comes into play as soon as you have terminated the lease and the tenant has remained on site beyond the date of termination of the lease. The owner-tenant law §§ 35-9A-164; 35-9A-204; 35-9A-401; 35-9A-404 and 35-9A-405 relate to the withholding of rent in lieu of repairs. Depending on the circumstances, the Alabama Notice to Vacate may take the form of a 30-day eviction notice, 60 days` notice, or 90-day evacuation notice. The required notice period is usually set out in the terms of the rental agreement.
